Linda asks…

How long must I keep MLM tools before I can throw them away?

I have a bunch of CDs, cassettes, and video from when I was in a MLM. I did declare them on my taxes as business tools, marketing and educational material. How long must I keep them for tax proof if I’m audited? I have not declared any tax deduction from this company in over 5 years.

As a general rule, all documents pertaining to a filed tax return, can be discarded after three years from the date that the return was due. In other words, your 2007 return was due on or before April 15, 2008. Any time after April 15, 2011, you may assume that you can discard these records, although, if you have storage space, it might be advisable to hold on to them until seven years have passed. In other words, to play it really safe, anytime after April 15, 2015 you should be home free.
